Terms of Use
The short version
- The Site is free to use for lawful purposes. Please do not misuse it or try to break it.
- Information on the Site is general. It is not an offer or a contract. Any paid work is governed by a separate written agreement that we both sign, and that agreement wins if it differs from these terms.
- Sending an enquiry or subscribing does not commit you or us to anything. You can unsubscribe any time.
- We are open about how your data is handled in our Privacy Policy, and about what we do and do not promise below.
- Nothing here limits rights you have by law that cannot be limited, including consumer rights where you live.
1. Who these terms are with
These terms (“Terms”) are between you and TechVigilant, Dhaka, Bangladesh (“TechVigilant”, “we”, “us”), and cover your use of techvigilant.com and www.techvigilant.com (the “Site”). If you use the Site on behalf of a company, you confirm you are allowed to accept these Terms for it. Questions: admin@techvigilant.com.
2. Accepting these terms
By using the Site you agree to these Terms and to our Privacy Policy, which explains how we handle personal data. If you do not agree, please do not use the Site. You must be old enough to form a binding contract where you live, or have a parent or guardian do so.
3. Using the Site
You may browse the Site and use its forms for their intended purpose: to contact us about work and to receive our newsletter. You agree not to:
- break the law or infringe anyone’s rights through your use of the Site;
- submit false, misleading or someone else’s details without their permission, or submit anything unlawful, abusive or malicious;
- attempt to probe, scan, overload, disrupt or gain unauthorised access to the Site, our systems or other users’ data, or bypass any security or rate-limit measure;
- use bots, scrapers or automated tools to submit forms or to copy the Site at scale, other than ordinary search-engine indexing;
- introduce malware, or use the Site to send spam.
If you find a security vulnerability, please report it to admin@techvigilant.com rather than exploiting it. We will not take action against good-faith research that avoids harming other people’s data and our service, and gives us reasonable time to fix the issue.
4. Our services and how work is agreed
The Site describes the kinds of work we do (AI development, forward-deployed engineering, security enhancement, cloud solutions and web development). That description is for information and is not an offer, quote or guarantee. Sending a project enquiry does not create a contract, an obligation to hire us, or an obligation for us to take on your project.
If we agree to work together, we will do so under a separate written agreement (for example a master services agreement and statement of work) that sets out scope, price, timelines, intellectual-property ownership, confidentiality, data-protection terms and liability. If that agreement conflicts with these Terms, the agreement prevails for the services it covers. Any figures, timelines or outcomes mentioned on the Site are illustrative unless written into that agreement.
Examples such as the item labelled “Sample testimonial” are illustrations and not endorsements by a real customer.
5. What you send us
You keep ownership of what you send through the forms. You give us permission to use it only to respond to your request, to send what you asked to receive, and to run and secure our business, as described in the Privacy Policy. Please do not send confidential or sensitive information through the forms before we have agreed on confidentiality terms; if you want a non-disclosure agreement first, say so in your message.
Newsletter. By ticking topics and subscribing, you ask us to email you those topics. We send the newsletter about once a week. You can change your choices or unsubscribe at any time using the link in any email, or by emailing us. Unsubscribing never affects a project or contract.
6. Our content and intellectual property
The Site, including its design, text, graphics, logo, animations and code, is owned by TechVigilant or its licensors and is protected by copyright and other laws. “TechVigilant”, the logo and related marks are ours. You may view the Site and share links to it, and may quote short extracts with credit and a link. You may not copy, republish, sell or create derivative works from the Site or its design without our written permission. Third-party names and marks belong to their owners and appear only to identify them.
7. Third-party services and links
The Site uses third-party services to work, such as Cloudflare for hosting and Google Fonts for typefaces, and may link to other websites. We do not control other sites and are not responsible for their content or practices. Your use of them is governed by their own terms and policies.
8. Information on the Site
We take care to keep the Site accurate and up to date, but it is provided for general information only. It is not legal, financial, security or other professional advice, and you should not rely on it as such. We may change, suspend or remove any part of the Site at any time, and the Site may occasionally be unavailable for maintenance or reasons outside our control.
9. Disclaimers
To the fullest extent the law allows, the Site is provided “as is” and “as available”, and we do not promise that it will be uninterrupted, error-free or free of harmful components. This does not affect any promise we make to you in a written services agreement, or any legal rights you have as a consumer that cannot be excluded.
10. Limits on our liability
Nothing in these Terms limits or excludes liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, (c) wilful misconduct or gross negligence, or (d) anything else that cannot be limited or excluded by law, including statutory rights of consumers.
Subject to that, and to the fullest extent the law allows, for your use of the Site itself (which is free): we are not liable for indirect or consequential loss, loss of profit, revenue, data or goodwill, and our total liability to you for all claims relating to the Site is limited to USD 100. Liability for paid services is set only by the written agreement for those services, not by this section.
11. Privacy
How we collect and use personal data is described in the Privacy Policy, which forms part of these Terms for the Site. In short: we collect only what you give us in the forms plus basic technical data, we do not sell it, and the Site sets no cookies.
12. Changes to these terms
We may update these Terms, for example when we add features or when the law changes. We show the “Last updated” date above and keep a log below. For material changes, we will give notice on the Site and, where we have your email for the newsletter or an open enquiry, by email at least 30 days before they take effect. Continued use after the effective date means you accept the updated Terms; if you do not, stop using the Site. Changes never apply retroactively to a dispute that has already started.

13. Suspending access
We may suspend or restrict access to the Site, or reject or delete a submission, if you break these Terms, if we must do so by law, or to protect the Site and other people. Where practical, we will tell you why. You can stop using the Site at any time.
14. Governing law and disputes
We would rather talk first: please email us and we will try in good faith to resolve any concern within 30 days. If we cannot, these Terms and any dispute about the Site are governed by the laws of Bangladesh, and the courts of Dhaka, Bangladesh have non-exclusive jurisdiction.
Consumers. If you use the Site as a consumer and live in the EU, the UK or another place whose law gives you mandatory consumer protections, this section does not take away those protections or your right to bring a claim in the courts of the country where you live.
15. General
If any part of these Terms is found unenforceable, the rest stays in force. Our not enforcing a right immediately does not waive it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a merger, acquisition or sale of the business. These Terms (with the Privacy Policy, and any signed services agreement for paid work) are the entire agreement between us about the Site. Neither of us is liable for failure caused by events outside our reasonable control. Only you and we have rights under these Terms.
